Conservation Commission Minutes 11/10/15
CONSERVATION COMMISSION
Town of Monterey, Massachusetts
                                                                        
MEETING DATE: November 10, 2015
Present: Timothy Lovett, David Dempsey, Claudia Crane and Dominic Stucker
The meeting convened at 6:00p.m.

BBD Monterey, LLC – 20 Bidwell RD – SMARDA – SMA16-01 remove several large pine trees with root damage (D. Lynch is the project manager)
John Field was present to review the project details.  16 pine trees with root damage will be cut down, stumps will be left intact (2-3 may be ground down). The project was issued a negative determination and will not require the filing of a NOI.

Heffernan – 22 Mt Hunger Rd – SMARDA – SMA16-02 thin four acres and clear one acre for horse pasture (D. Dempsey is the project manager)
Esther Heffernan was present to review the project details.  Lloyd Gelwan and his attorney were present as objectors to the project and noted that he was recording the hearing (he owns undeveloped property across the street from here as well as 35 Mt Hunger Rd).  The total acreage of the land is 7.1 and it is just barely in the mapped scenic mountain area.  A cutting plan will be drawn up by Roger Kimberly.  Mr. Gelwan is concerned about the extent of the horse pasture and its impact.  Mr. Gelwan states that the silt fence has never been maintained properly, his well has been adversely affected and that debris was dumped on his property in a wetland.  He also feels that no one in town has been forthcoming with information about the project(s) surrounding the horse farm/pasture.  The Commission explained that the only work that falls within their jurisdiction is work within 100 feet of a wetland or within a scenic mountain mapped area and suggested that if his well has been affected he should contact the Board of Health.  Ms. Heffernan confirmed that the land she purchased is not going to be combined with Ms. Timlege’s property.  The project was given a negative determination and will not require the filing of a NOI.

The Commission granted the request to extend DEP file #230-0249 until 1/9/19

For Discussion:
  • A resident of New Marlborough, Mike Nahmeias that lives on Lake Buel came in to discuss an activity that has been bothering him; he has issues with Lake Buel being lowered right before winter.  The Commission wasn’t aware that New Marlborough had the capability of lowering the lake but Mike stated that there is a device there installed by the Lake Buel district.  Mike will meet with the New Marlborough Conservation Commission regarding his concerns at their next meeting.
